Wet Hire Terms & Conditions

The attached terms and conditions form the contract between us, Ivy Events Limited (T/A Sweetpea and Ivy) and you, (‘The Hirer’). All agreements will be subject to these terms and conditions, although your statutory rights will not be affected. We reserve the right to amend or revise these terms and conditions, but those in effect at the time of booking will apply to you. Any work undertaken by Ivy Events Limited (T/A Sweetpea and Ivy) will be undertaken in accordance with these terms and conditions unless specifically varied in writing and agreed by us both prior to the event.

Terms used:
Wet Hire:- this refers to an arrangement whereby Ivy Events Limited (T/A Sweetpea and Ivy) undertake all the work to set up the event.
Dry Hire:- this refers to an arrangement whereby the hirer is responsible for all hired items during the hire period and their safe collection and return.

1.Quotations
Following an initial discussion with you, a written quotation will be provided.
This quotation will be valid for a period of 30 days only from that date. Any prices quoted may be subject to amendment if the change is outside the control of Ivy Events Limited (T/A Sweetpea and Ivy). The Hirer will accept such changes.
Any queries about the quotation must be agreed prior to the booking being accepted by Ivy Events Limited (T/A Sweetpea and Ivy).

2.Bookings
All bookings will be deemed as provisional until:
a. The booking fee equivalent to 50% of the total cost is paid.
b. The terms and conditions as laid out within the agreement have been signed and returned to Ivy Events Limited (T/A Sweetpea and Ivy).
The booking fee is non-refundable but is transferrable. The booking fee is payable within 7 days of the invoice issued. If it is not paid the booking will not be regarded as a confirmed booking and the date will be released.
The booking fee reserves the date to be booked and ensures those booked items are available.
In the event of a late booking – that is the booking is made by the Hirer within 28 days of the event taking place, payment is required in full.

3. Hire of Items
All items supplied by Ivy Events Limited (T/A Sweetpea and Ivy) under the agreed terms and conditions are for hire only. They will remain the sole property of Ivy Events Limited (T/A Sweetpea and Ivy) only, always, and on all occasions.
The hire period will be effective for a set period of 1-3 days to be agreed upon booking.
Such hire period can only be extended by agreement of both parties, prior to the commencement of the booking. Extra charges will be applied to such an extension. See section 5.
The Hirer will accept full responsibility for all items as supplied for the duration of the hire period. This responsibility cannot be passed to any other third party at any time.
The Hirer must ensure all items are maintained in good order for the duration of the hire period or until they are returned to the possession of Ivy Events Limited (T/A Sweetpea and Ivy).

4.Security deposit
A security deposit of £500 is required to be paid by the Hirer, by bank transfer, no later than 7 days before the event. This amount will be refunded within 10 days of collection of the items, provided there is no loss or damage to the hired items.
In the event Ivy Events Limited (T/A Sweetpea and Ivy) find lost or damaged items, the Hirer will be notified within a 48-hour period. Charges will be made for replacement items, and this will initially be deducted from the Hirers security deposit. Should replacement costs exceed the security deposit an invoice will be provided to the Hirer and that must be discharged within 10 days of receipt.


5. Additional charges
Delivery and collection of the hired items will be undertaken by Ivy Events Limited (T/A Sweetpea and Ivy) only. A rate of 45p per mile will be charged for each round trip and will be included as part of any quote provided at the outset of the booking (see section 1)
Additional time as agreed subject to section 3, will be charged at 10% of the agreed price per day. Full payment must be made by the Hirer no later than 28 days before the event.

6. Personal items
Should the Hirer provide specific items such as candles or floristry, to be used at the event, these will remain the property and the responsibility of the Hirer alone. They will remain at the venue for the Hirer to collect directly.
Should Ivy Events Limited (T/A Sweetpea and Ivy) provide specific items such as candles or stationery, to be used at the event, these will remain the property and responsibility of the Hirer alone. They will remain at the venue for the Hirer to collect directly.

7.Payment
The Hirer will be provided with a quote in respect of all the items to be hired from Ivy Events Limited (T/A Sweetpea and Ivy). This will include the delivery and collection fees as referred to in section 5.
In the event, the Hirer wishes to proceed with the booking, payment will be required as referred to in section 2.
Final payment is required no later than 28 days prior to the event. Failure to make the final payment will be considered a termination of the contract by the Hirer.
In the event the hirer seeks to amend the supplied items list following the booking being confirmed, such items will not be supplied. Any monies paid by the Hirer in relation to those specific items will not be refunded and no further monies will be due to Ivy Events Limited (T/A Sweetpea and Ivy).
All payments will be made to Ivy Events Limited (T/A Sweetpea and Ivy) by bank transfer. Details will be provided on all invoices issued.
It is the responsibility of the Hirer to ensure all payments are made in accordance with the agreed terms and conditions.

8. Cancellation
Any cancellation must be provided in writing to Ivy Events Limited (T/A Sweetpea and Ivy).
These terms apply regardless of whether the Hirer:-
a. Cancels the entire event
b. Cancels partial use of the facilities for the event
c. Reduces the duration of the event
d. Reduces the number of items supplied to the event
In the event of a cancellation, the booking fee is not refundable under any circumstances.
In the event a cancellation is made prior to the 28 day final payment date, no further monies will be due.
In the event a cancellation is made within 28 days of the event date, the outstanding fee will remain due.
Ivy Events Limited (T/A Sweetpea and Ivy) reserve the right to cancel the booking if there has been a change of more than 40% of the original booking. The Hirer will receive notification in writing.

9. Postponements
In the event of a postponement being notified in writing to Ivy Events Limited (T/A Sweetpea and Ivy) by the Hirer, and the new date being within 150 days of the original date, any monies already paid by the Hirer will be credited to the new date. Ivy Events Limited (T/A Sweetpea and Ivy) reserve the right to review the original contract and costings.

9. Liability
Ivy Events Limited (T/A Sweetpea and Ivy) hold Public Liability insurance of up to £3 million. A copy of the certificate of insurance can be provided in the event it is required.
Ivy Events Limited (T/A Sweetpea and Ivy) deny responsibility for any damage to property or persons arising as a result of the hire agreement, this includes any damage, loss or injury caused as result of the use of candles.
It is the responsibility of the Hirer to secure permission from the venue for the use of the hired items and for any candles.

10. Force Majeure
Ivy Events Limited (T/A Sweetpea and Ivy) will not be liable for any delay or failure to perform any of its obligations if such a delay or failure arises from events or circumstances that are reasonably outside of their control. These include but are not limited to acts of God, pandemic, accident, war, fire, breakdown of plant or machinery.
